Sub: Complaints not to issue new draft after cancellation of old draft.
Dear Sir,
1. I have received the draft under the negotiable instrument act and presented the draft in my collecting bank but the same is return due to any reason so the payment can not be creditedin my account.
2. I am the lawful beneficiary of the above demand draft and I am the “holder”,” holder in due course” as also the “holder for value” therefore under section 8 and 9 of the negotiable Instrument Act, 1881 I have both the legal and equitable rights to call upon the issuing B.O. to issue fresh demand.
4. Section 45A of the Negotiable Instruments Act, 1881 provides a legal remedy to the holder against the drawer. i.e., Issuing Branch Office to make the duplicate after giving the satisfactory indemnity.
5. I have already sent Mutilated old original draft, Indemnity bond duly executed in the favour of bank and other necessary documents to the branch manager through my advocate Mr.Sanjay Nagpal, but till date no response from there side despite of so many telephones and reminders.
6. I am request with your honour, Kindly take the matter in your hands, your quick and action shall be highly appreciated.
